Hydroseed Supply is a wholesale distributor. These terms are written for contractors buying materials and equipment by freight — read the freight and damage sections before your first pallet arrives.

By visiting this site and using the information, resources, services, products and tools we provide, you agree to these terms, together with our Privacy Policy. We may change these terms from time to time; it is your responsibility to review them periodically.

Hydroseed Supply sells wholesale to contractors, landscape companies, builders, municipalities and other businesses. Products are sold for commercial application by trained operators. Nothing on this site is an offer of consumer goods, and these terms are written on the assumption that the buyer is a business acting in the course of its trade.
Prices shown are typically list prices and are subject to trade discount and to change without notice. Prices may also change without notice due to unforeseen cost increases of products or raw materials. We carefully check pricing and product specifications, but occasionally errors can occur, therefore we reserve the right to change both without notice, and we are not responsible for customer pricing errors. Some variation between picture and product may occur. Some products listed may be non-stock items.
The Project Cart on this site produces a quote request, not an order, and does not take payment. Submitting a quote request does not reserve stock or lock a price. A quote becomes binding only when we confirm it in writing, and quoted freight is confirmed at the time of quote. Quotes are typically answered within 2 business days.
Items shipped by freight or on pallets ship FOB origin. Title and risk of loss pass to the buyer when the carrier takes possession at the shipping point.
Freight is always additional. Product prices are quoted ex-freight. Freight is charged in addition to the price of the goods on every order and is confirmed per shipment to your delivery ZIP, except where a specific product listing or a written offer from us expressly states that shipping is included — for example, items marked "Ships Free" for the stated pack size and delivery area. Where no such statement appears, freight applies. A freight amount shown on a quote applies to that quote only, at the address and quantity quoted; it does not carry to future orders, and re-routing, re-delivery, storage, limited-access, liftgate, residential or detention charges billed by the carrier are additional.
Several product lines ship directly from the manufacturer in full-pallet or full-truckload lots and cannot be split, combined or diverted once released. Lead times for freight goods are confirmed on your quote.
Lead time. Stocked items typically ship within 2 business days of a confirmed order. Freight, palletized and made-to-order goods ship on the lead time confirmed on your quote, which depends on the manufacturer's production and truck scheduling. Lead times are estimates, not guarantees, and are not a basis for consequential damages — see section 11.
Inspect every delivery before the driver leaves. Visible damage, wet or torn packaging, or a short pallet count must be noted on the delivery receipt or bill of lading at the time of delivery, before you sign. There is no window for this — it happens at the door or not at all. A receipt signed clear is the carrier's proof the shipment arrived intact, and once signed clear a damage claim generally cannot be recovered from the carrier or from us.
Concealed damage must be reported to service@hydroseedsupply.com within 48 hours of delivery, with your order or quote number, photographs of the damage and of the packaging as delivered, and a photograph of the annotated delivery receipt. Claims reported after 48 hours cannot be filed with the carrier and cannot be credited.
Where a claim is properly documented we will file it with the carrier and replace or credit the affected goods. You do not pay return freight on a valid damage claim.
The following cannot be returned for convenience once shipped: palletized mulch, tackifier and bagged goods; erosion control blankets and turf reinforcement mats; seed and biological amendments; filled silt sock; custom-built equipment; and custom-ordered supplies such as mixed or made-to-order seed and mulch. These move in full-pallet or full-truckload lots from the manufacturer and cannot be returned to stock. Order corrections must be raised before the order is released to the carrier.
For stocked items not covered by section 7:
Merchandise that has been worn, used or altered will not be accepted for return or exchange. Unauthorized returns, and returns delivered to any address other than the one given in your return instructions, may be refused or returned to sender at your cost.
Restocking fee. All returned items are subject to a 30% restocking fee, deducted from your refund. We do not refund the original shipping and handling paid on the order.
Exchanges. If your item is in like-new condition you may exchange it for a different type or brand. Return shipping remains your cost.
You agree to use this site and the resources we provide lawfully, and not to interfere with its operation, security or availability, or to attempt to access data or systems you have not been granted access to.
By using our website, you understand and agree that all Resources we provide are "as is" and "as available". This means that we do not represent or warrant to you that:
Furthermore, you understand and agree that any content downloaded or otherwise obtained through the use of our Resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices or for any loss of data that may result. No information or advice, whether expressed, implied, oral or written, obtained by you from Hydroseed Supply, LLC. or through any Resources we provide shall create any warranty, guarantee or condition of any kind, except for those expressly outlined in this agreement.
Manufactured goods carry only the warranty offered by their manufacturer, where one applies. Application results depend on site conditions, preparation, weather and workmanship, which are outside our control, and we do not warrant the outcome of any application.
In conjunction with the Limitation of Warranties above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. Hydroseed Supply, LLC. will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime, to the full extent that applicable limitation of liability laws apply.

If these terms change we will revise the effective date above, and for material changes we will say so more prominently than that.
